In simple terms, New Hampshire’s conflict of interest law seeks to prevent conflicts between private interests and public duties. Often times, municipal officials are faced with difficult questions: “Do I have a conflict of interest?” “Must I recuse myself?” “Should I recuse myself?” Alternatively, these may be questions that municipal officials should be asking more often of themselves—but aren’t. Either way, precisely defining “conflicts of interest” as it applies to municipal decision making is difficult because the existence of a conflict of interest depends largely on the specific facts of each case.
